EL RENO, Okla. (AP) - A Canadian County judge has allowed attorneys for a man charged with five counts of first-degree murder to withdraw from the case.
District Judge Gary Miller on Thursday granted a request from lawyers with the Oklahoma Indigent Defense System to no longer represent Joshua Durcho, who is accused of killing former girlfriend, Summer Rust, and her four young children in January 2009.
Miller ruled that a conflict of interest had developed between the attorneys and Durcho, but he declined a motion to postpone the Sept. 13 trial. He says he'll consider rescheduling the trial after new attorneys are appointed.
Prosecutors are seeking the death penalty for Durcho, who appeared at the hearing in shackles and an orange inmate jumpsuit.
