Officers in 'Drive-By Shooting' to Stand Trial

Two Oklahoma City police officers will go to trial for a drive by shooting incident last summer.  8-year veteran Diron Carter and 7-year vet Michael McKethan are accused of shooting a gun at a group of people, and fleeing the scene while they were off-duty.

Oklahoma Count District Attorney David Prater said, "My personal opinion is that police officers who want to behave in the manor that they did, they should not be on the Oklahoma City Police Department."

Today, a judge ruled that Officer Diron Carter will face a jury for a drive-by shooting.  It happened at 2 a-m outside of Night Trips back in June.  Michael McKethan testified that carter shot the .40 caliber mini glock.  Previous reports say the bullet was fired toward people in the parking lot.  McKethan said he heard the shot, saw Carter's arm with a gun come back into the car, but didn't see the weapon fire.  McKethan continues to reiterated that he'd be willing to take a lie detector test to prove what he saw.

Scott Adams, Michael McKethan's Attorney said, "He wants to get this behind him.  What he said was the truth.  The shot came from the driver's side, unfortunately Mr. Carter did it he just needs to own up to it and let us move on with our lives."

But there were conflicting accounts of what occurred that night.  McKethan said that he was in the passenger seat the entire time during the incident, which the defense argued that Carter couldn't have shot the gun at the people from the driver's seat.  District Attorney David Prater said witnesses saw a man with a tattoo on his right shoulder fire the weapon out the window.  McKethan stated under oath that he has a band tattoo around his left bicep, and Mr. Carter has a tattoo on his left shoulder.

An Oklahoma City police sargent testified that Carter admitted he accidentally fired the gun.  The defense was pleased with how the evidence came out.

"When 12 people hear this evidence, and the conflicts that are all throughout it.  There's no way that Diron carter is going to be convicted of this charge," Patty High, Carter's Attorney explained.

Michael McKethan has already waived his preliminary hearing, and his attorney hopes that charges against him will be dropped or amended.  Investigators say both men had been drinking the night of the incident.
